Terms of Service

1. Acceptance of Terms

By installing, copying, or otherwise using SideKick LB ("Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Software.

These Terms are offered subject to your acceptance without modification of all terms and conditions contained herein and all operating rules, policies (including our Privacy Policy) that may be published from time to time.

2. Description of Service

SideKick LB is a Windows companion application for Light Blue studio management software. It provides integration with GoHighLevel CRM and workflow automation features.

The Software operates entirely locally on your computer. We do NOT store, process, or have access to your client data or API credentials.

3. Your Account & Responsibilities

Once you create an account or install the Software, you are responsible for:

  • Maintaining the security of your account and credentials
  • All activities that occur under your account
  • Ensuring your use complies with applicable laws and regulations
  • The accuracy of client data and bookings you create
  • Complying with terms of service for GoHighLevel, Light Blue, and other integrated services

4. Third-Party Services

The Software integrates with third-party services including but not limited to GoHighLevel, Light Blue, and LemonSqueezy. You acknowledge that:

  • The license to each Third-Party Service is a binding agreement between YOU and the Application Provider
  • Zoom Photography Ltd is NOT acting as agent for any Third-Party Service provider
  • Zoom Photography Ltd is NOT a party to the license between you and any Third-Party Service provider
  • The Application Provider of each Third-Party Service is solely responsible for that service, the content therein, any warranties to the extent not disclaimed, and any claims relating to that service
  • We have no control over Third-Party Services and are not responsible for their contents, availability, or use
  • Third-Party Services may change their APIs, pricing, or terms at any time without notice to us

We disclaim any responsibility for any harm resulting from your use of Third-Party Services.

5. Billing, Cancellation & Refunds

SideKick LB is sold on an annual subscription basis through LemonSqueezy.

  • Subscriptions automatically renew unless cancelled
  • Refunds are available within 14 days of purchase if the Software is unused
  • Price changes will be notified 30 days before renewal
  • Cancellation takes effect at the end of your current billing period

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

Zoom Photography Ltd and its suppliers and licensors hereby disclaim all warranties of any kind, including but not limited to:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS
  • QUIET ENJOYMENT
  • TITLE

Neither Zoom Photography Ltd nor its suppliers and licensors makes any warranty that the Software will be error free or that access will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Software at your own discretion and risk.

7. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ZOOM PHOTOGRAPHY LTD SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Damages for loss of profits, goodwill, use, data, or other intangible losses
  • The use or inability to use the Software
  • The cost of procurement of substitute goods and services
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Software
  • Any bugs, errors, or malfunctions arising in the Software
  • Any rejection of your data by GoHighLevel, Light Blue, or other Third-Party Services
  • Data synchronization errors between Light Blue and GHL
  • Any amounts exceeding the fees paid by you in the twelve (12) months prior to the cause of action

Zoom Photography Ltd shall have no liability for any failure or delay due to matters beyond its reasonable control.

8. Indemnification

You agree to indemnify and hold harmless Zoom Photography Ltd, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to legal fees) arising from:

  • Your use of and access to the Software
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, intellectual property, or privacy right
  • Any claim arising from incorrect client data or bookings created using the Software
  • Your failure to comply with GoHighLevel, Light Blue, or other Third-Party Service terms of service

This defense and indemnification obligation will survive termination of these Terms and your use of the Software.

9. Changes to Terms

Zoom Photography Ltd reserves the right, at its sole discretion, to modify or replace any part of these Terms. Your continued use of the Software following the posting of any changes constitutes acceptance of those changes.

10. Termination

Zoom Photography Ltd may terminate your access to the Software at any time, with or without cause, with or without notice. All provisions which by their nature should survive termination shall survive termination, including warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
